Domestic workers have the following rights under Quebec’s employment standards and anti-discrimination laws:
You have the right to be paid the minimum wage.
You have the right to be paid for overtime or to request time-off equivalent to the hours of overtime worked, increased by 50%.
You have the right to a workplace free from psychological and sexual harassment.
After three months of work, you have the right to be absent because of illness or injury.
You have the right to a 30-minute break after 5 hours of continuous work.
You have the right to a rest period of at least 32 consecutive hours every week.
You have the right to be paid on a regular basis.
You have the right to refuse overtime after 50 hours of work a week.
You have the right to two weeks annual leave after 12 months of uninterrupted service for the same employer.
After three months of uninterrupted service, you have the right to be given notice by your employer before your contract is terminated. This requirement does not apply if you have a fix-term contract. The duration of the notice varies according to the amount of time you have been working.
If your employer does not give you notice of termination, you have the right to be paid a compensatory indemnity. This is an amount of money equal to the regular wages you would have earned during the notice period.
You have the right to refuse work that is dangerous to your health, safety or physical well-being.
